This privacy policy explains how Covr Pty Ltd (ABN 33 627 046 413) and its related entities (Covr) collects and handles personal information. In this policy “we”, “our” and “us” refers to Covr.

Covrs' Privacy Commitment

We recognise the importance of your privacy, and that you have a right to control how your personal information is collected and used. We also understand that supplying personal information is an act of trust and we take that seriously. Unless you directly give us permission to do otherwise, Covr will only collect and use your personal information as set out in this Privacy Policy (Privacy Policy or Policy). We take our obligations under the Privacy Act 1988 (the Act) and the Australian Privacy Principles (APPs) very seriously and have implemented practices, procedures and systems to ensure we comply with those laws.

Collection from you

We collect personal information directly from you in the normal course of providing services instore and/or online such as when you:

  • purchase products or services from us;
  • participate in one of our competitions;
  • apply for a membership with our VIP Customer Loyalty Program;
  • access your existing VIP Customer Loyalty Program through our Website;
  • request information about us or our products or services;
  • use our Website;
  • request a refund, return or make a claim;
  • lay-by products or place products on hold;
  • provide feedback, respond to a survey, change your email preferences;
  • participate in a promotion or competition;
  • register to become a member;
  • apply to or become an employee of Covrs, or
  • otherwise supply personal information to us by telephone, facsimile, email, post or in person.

Collection by other lawful and fair means

We may also collect information about how you use our Website. We may do this when you click on a link from our Website or visit a website, app or social media platform which displays our advertisements. This information is derived from cookies. We use first and third party cookies to allow us to personalise your browsing and online shopping experience on our Website, including to identify the computer you used to access our Website, the pages you accessed or viewed and to remember items in your shopping cart. You can configure your internet browser to disable cookies or not accept them, however we may not be able to provide you with all the service or functionality you require on our Website if you choose to do so.

 

Automatically collected personal information

We automatically record information from your device and its software when you access our Website, including your IP address, browser and device type, internet service provider, mobile phone carrier, platform type, the website from which you came and the website to which you are going when you leave our Website, date and time stamp and cookies that may uniquely identify your browser or account.

Third Party Payment Processor

Covr uses third party payment processors and gateways to process payments made to us when using our Website. All personal information, including any financial information such as credit card numbers, is collected and used directly by our third party payment processors and gateways as set out on our website, whose use of your personal information is governed by their own terms and conditions and privacy policy. We do not store or retain any sensitive financial/billing information (being credit card numbers, bank account details, etc.), obtained in connection with processing such payments.

Unsolicited personal information

In some circumstances we may receive personal information that we have not requested. If this occurs, we will comply with our obligations under the Act. We may de-identify and/or destroy this information unless we are required to keep it by law.

Why we collect your personal information

We collect personal information to provide you with the best shopping experience and allow us to:

  • to meet any regulatory requirements which apply to our business;
  • to market and sell our products and services, including to notify you of shop events and special offers that may be of interest to you;

  • to process and/or administer services to you as a member of the VIP Customer Loyalty Program that you may register with us;
  • administering, facilitating, processing and/or dealing with your relationship with us, any transactions or activities carried out by you on the Website or at our retail stores, including your participation in contests or social events organised by us;
  • for communication with you and to provide messaging and/or communications to you in association with the functions and features of the our service, competition results, special offers (including any associated with the VIP Customer Loyalty Program);
  • for communicating to you any announcements and updates, updated terms, conditions and policies, security alerts, technical notices, support and administrative messages;
  • for analysis, monitoring, development and improvement of our Services, including other products or services;

Direct marketing

We may use your personal information to provide you with direct marketing materials if you would reasonably expect us to or if you consent to receive direct marketing materials, including in relation to the VIP Customer Loyalty Program.

We may communicate with you via phone, email, social media, SMS, or regular mail. If you have indicated a preference for a method of communication, we will endeavour to use that method wherever practical to do so.

We will seek your consent to provide you with direct marketing materials if we have obtained your personal information from a third party. Direct marketing material may include promotional material about us or the products or services we offer. Mobile Terms of Service

The Covr mobile message service (the "Service") is operated by Covr (“Covr”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Covr's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Covr through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Covr. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Covr mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Disclosure of personal information

We may disclose your personal information to our shareholders, officers and employees, other businesses within our group of companies, service providers who assist us in our business operations and recruitment activities (including third party service providers based overseas), government agencies, parties involved in the purchase or sale of any of our businesses, other third parties, (including parties that we engage to process orders for our products, provide you with goods or services on our behalf or who are connected with or involved in our relationship with you), or otherwise as required by law.

We will not sell your personal information to third parties for marketing purposes. Unless otherwise specified in this Privacy Policy, we will not disclose any of your personal information to any other organisation unless the disclosure is required by law, is otherwise permitted by the Act, or is with your consent.

Disclosure to other third parties

We may share your personal information with third parties if it is reasonably related to the provision of our services or use of our Website. The third parties that we may share your Personal Information with includes consultants, contractors, credit agencies, debt collection agencies and other service providers to us that perform services on our behalf. Such services we procure may include identifying and disseminating advertisements, enforcement of our website Terms and Conditions, providing fraud detection and prevention services, processing payments or providing analytics services. We may also share your personal information with our business partners who offer goods or services to you jointly with us (for example, contests or promotions, including benefits relating to the VIP Customer Loyalty Program).

Security

We will take reasonable steps to protect your personal information from misuse, interference and loss and from unauthorised access, modification or disclosure. When conducting online transactions from our Website, we use a industry standard 128-bit SSL (secure sockets layer) which encrypts sensitive information as it is transferred over the internet. This encryption scrambles details such as credit card numbers, billing details and delivery addresses so that computers are unable to decipher the information.

We will keep your personal information only for as long as required for our business purposes and otherwise as required by Australian law. Where we no longer need to keep your personal information for a permitted purpose, we will take reasonable steps to destroy your personal information or to ensure that the information is de-identified.

Third party websites and social media

Our Website may, from time to time, contain links to and from websites which are owned or operated by other parties. You acknowledge and agree that we have no control over, and shall not be liable for, the privacy practices or content of these third party websites and we do not make any representation about the privacy practices of, any third-party websites, whether or not linked from or transferred from our Services. You are responsible for checking the privacy policy of any such websites and applications so that you can be informed of how they will handle personal information.

We run pages on a number of social media platforms, including Facebook, Instagram, Pinterest and Google Plus (Social Media Platforms). By accessing, interacting with and using our social media pages, you agree to the terms and privacy policy of those Social Media Platforms. You acknowledge and agree that these Social Media Platforms may collect your information and that the privacy practices of those Social Media Platforms are not controlled by us and that we hold no responsibility for such privacy practices.

Social Media Platforms also allow public access to your public social media profile, which may include your username, age range, country/language, list of friends or other information that you make publicly available and you understand that such information may therefore be accessible by us if you interact with its social media pages.

We may from time to time, have access to statistics regarding the number of views, navigation patterns, posts that you like, comment on or share and any user interactions with our social media pages and may use such information for the purpose of its marketing and promotion strategies.

Amendments

We reserve the right to amend this Privacy Policy from time to time as we see fit. While we endeavour to notify you as soon as reasonably possible of any changes to our Policies by email or by a notice on our Website, it is your responsibility to keep up to date with any changes or amendments by checking this page prior to using our Website.

Access, updating and correcting personal information we hold about you

We will take reasonable steps to ensure that the personal information that we hold is accurate, up-to-date and complete. Upon your written request we will provide you with a copy of your personal information that we hold about you unless providing you with access would unreasonably impact upon the privacy of others or is not otherwise permitted under the APPs or at law. If you wish to have your personal information destroyed or de-identified, please let us know and we will take reasonable steps to do so (unless we need to keep it for legal, auditing or internal risk management reasons, or as otherwise required by law).

Anonymity

Wherever it is lawful and practical, you have the option of using a pseudonym or not identifying yourself when dealing with us. However, by doing so you acknowledge that it may affect our ability to provide our products and services to you. If you apply to or become an employee you must provide personal information that is true and accurate and not misleading or deceptive.
